§266-2 Powers and duties of department

AMEND: Add 2 paragraphs after first paragraph of section (b)

Facilities planned to meet cruise ship demand shall not in any way curtail or negatively impact existing cultural, recreational, small boat or freight users.

In the event that cruise ship demand exceeds available facilities, cruise ship harbor usage shall be limited to that which is available without impact to freight operations.


§266-3 Rules.
(a) The director of transportation may adopt rules as necessary to:
  • (1) Regulate the manner in which all vessels may enter and moor, anchor or dock in the commercial harbors, ports, and roadsteads of the State, or move from one dock, wharf, pier, quay, bulkhead, landing, anchorage, or mooring to another within the commercial harbors, ports, or roadsteads;

AMEND: add to the end:

..or roadsteads, giving preference to freight and Hawaiian cultural activities over cruise ships;
